{"id":766,"date":"2011-03-30T17:23:30","date_gmt":"2011-03-30T21:23:30","guid":{"rendered":"http:\/\/www.domainandtrademark.com\/?p=766"},"modified":"2019-08-09T09:10:28","modified_gmt":"2019-08-09T13:10:28","slug":"virginia-tech-sued-for-trademark-fraud","status":"publish","type":"post","link":"https:\/\/www.cscdbs.com\/blog\/virginia-tech-sued-for-trademark-fraud\/","title":{"rendered":"Virginia Tech sued for trademark fraud"},"content":{"rendered":"<p>Virginia Tech has been hit with a counterclaim after it attempted to sue a company for using its &#8216;Hokie&#8217; <a href=\"https:\/\/www.cscglobal.com\/global\/web\/csc\/trademark-searching.html\">trademark<\/a> without the university&#8217;s consent.<\/p>\n<p>John Wilburn of Hokie Real Estate, the company served in the original suit, has petitioned the U.S. Patent and Trademark Office to block the action by Virginia Tech.<\/p>\n<p>Wilburn claims the college is guilty of making fraudulent claims in its &#8216;Hokies&#8217; trademark application.<\/p>\n<p>In an email to <em>The Roanoke Times<\/em>, Wilburn&#8217;s attorney, Keith Finch, claimed that Virginia Tech had said it was &#8220;using the term Hokies on certain types of goods when it was not actually doing so.&#8221;<\/p>\n<p>If the allegations are true, the university could lose its trademark dispute with Wilburn.<\/p>\n<p>However, Mark Owczarski, a spokesperson for Virginia Tech, told the news provider: &#8220;This counterclaim is a stretch of the law and the facts.&#8221;<\/p>\n<p>Recently, Florida State University challenged a number of high schools in the state to give up their Seminoles logos, which the institution claimed breached trademark law.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Virginia Tech has been hit with a counterclaim after it attempted to sue a company for using its &#8216;Hokie&#8217; trademark without the university&#8217;s consent.
