{"id":836,"date":"2011-04-26T14:13:54","date_gmt":"2011-04-26T18:13:54","guid":{"rendered":"http:\/\/www.domainandtrademark.com\/?p=836"},"modified":"2019-08-09T09:10:10","modified_gmt":"2019-08-09T13:10:10","slug":"wipo-finds-domain-name-registered-in-bad-faith","status":"publish","type":"post","link":"https:\/\/www.cscdbs.com\/blog\/wipo-finds-domain-name-registered-in-bad-faith\/","title":{"rendered":"WIPO finds domain name &#8216;registered in bad faith&#8217;"},"content":{"rendered":"<p>The World Intellectual Property Organization (WIPO) has stripped ownership of the XPole.com <a href=\"https:\/\/www.cscglobal.com\/global\/web\/csc\/domain-name-management.html\">domain name<\/a> from a South Korean Internet user.<\/p>\n<p>Seoul-based Jeongyong Cho has been forced to hand over the rights to the Web address to Vertical Leisure Ltd., which holds the XPole <a href=\"https:\/\/www.cscglobal.com\/global\/web\/csc\/trademark-searching.html\">trademark<\/a> in several countries.<\/p>\n<p>Mr. Cho was found to hold no trademarks relating to the term XPole, and WIPO said he had acquired the domain name for the purpose of selling it for a profit.<\/p>\n<p>WIPO arbitrators ruled that the domain name had been registered in bad faith, as the existing holder had no practical use for the Web address.<\/p>\n<p>At present, the domain name is simply used to redirect Internet users to the DancePoleKit.com website.<\/p>\n<p>The organization added that the &#8220;only credible explanation for the current use of the domain name is that [Cho] is seeking to take advantage of the similarity between the domain name and complainant&#8217;s website to draw Internet users to that site for commercial advantage.&#8221;<\/p>\n<p>Last week, the U.S. firm Chief Architect won a WIPO dispute it filed against CAD Australia, with regards to the chiefarchitect.com.au domain name.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The World Intellectual Property Organization (WIPO) has stripped ownership of the XPole.com domain name from a South Korean Internet user.
