{"id":857,"date":"2011-05-06T16:42:43","date_gmt":"2011-05-06T20:42:43","guid":{"rendered":"http:\/\/www.domainandtrademark.com\/?p=857"},"modified":"2019-08-09T09:09:54","modified_gmt":"2019-08-09T13:09:54","slug":"new-gtld-regime-could-exacerbate-cybersquatting-risks","status":"publish","type":"post","link":"https:\/\/www.cscdbs.com\/blog\/new-gtld-regime-could-exacerbate-cybersquatting-risks\/","title":{"rendered":"New gTLD regime &#8216;could exacerbate cybersquatting risks&#8217;"},"content":{"rendered":"<p>The U.S. House Judiciary Subcommittee on Intellectual Property, Competition and the Internet has expressed concerns about the forthcoming generic top-level domain (gTLD) regime.<\/p>\n<p>A hearing was staged this week to investigate the potential effects of expanding internet <a href=\"https:\/\/www.cscglobal.com\/global\/web\/csc\/domain-name-management.html\">domain names<\/a> beyond traditional suffixes such as .com, .net and .org.<\/p>\n<p>The subcommittee looked into plans by the Internet Corporation for Assigned Names and Numbers (<a href=\"https:\/\/www.cscglobal.com\/global\/web\/csc\/domain-name-management.html\">ICANN<\/a>) to expand gTLDs beyond the existing variants, giving domain name registrants the opportunity to create their own TLD.<\/p>\n<p>Several members of the subcommittee acknowledged that the gTLD regime would have the likely effect of encouraging online investment.<\/p>\n<p>However, concerns were also raised about the potential for gTLDs to contribute to the problem of <a href=\"https:\/\/www.cscglobal.com\/global\/web\/csc\/domain-recovery.html\">cybersquatting<\/a>.<\/p>\n<p>Philadelphia-based attorney Philip Foret claimed there could be a &#8220;landrush&#8221; of individuals registering domain names similar to popular websites which are already in existence.<\/p>\n<p>This could lead to a significant increase in costs for <a href=\"https:\/\/www.cscglobal.com\/global\/web\/csc\/trademark-searching.html\">trademark<\/a> policing, he suggested.<\/p>\n<p>&#8220;It&#8217;s really the smaller and medium sized companies with low or no legal budgets that would be most affected when having to police trademark rights,&#8221; Foret claimed.<\/p>\n<p>&#8220;They may have to spend a lot of company resources protecting their brands.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. House Judiciary Subcommittee on Intellectual Property, Competition and the Internet has expressed concerns about the forthcoming generic top-level domain (gTLD) regime.
